Rules for the return of goods

The return of goods shall be carried out in accordance with the Order of the Minister of Economy of the Republic of Lithuania of 29 June 2001 No 217 “On the Approval of the Rules of Return and Exchange”.

The Buyer shall have the right to return the goods within 14 calendar days from the date of delivery to the Buyer. This means that the buyer has the right to return the goods to the seller within the mentioned period, if he changes his mind or decides for other reasons to reject the goods purchased, and to receive a refund.

Only goods that are intact and have not lost their physical appearance or original functionality, together with their original packaging, accessories and documents, intact and undamaged, may be returned. Gifts received in exchange for the goods must also be returned.

In order to exercise the right of return, the buyer must comply with the following conditions:

Within 14 calendar days from the date of delivery of the goods to the buyer, to notify the seller in writing or orally about the intention to return the goods.

In writing, fill in a free-form request form, indicating the order number, the names of the goods to be returned, the quantities, the price paid, and the buyer’s details: name, surname, contact telephone number, and (optionally) the reason for the return, as well as the details of the account to which the refund will be credited. The request must be sent to: info@carplay.lt and confirmation must be received.

The Buyer shall return the goods to the Seller immediately and in any event within 14 calendar days of notifying the Seller of his decision to return the goods by the means provided for:

Hand over the goods to the seller or to a person authorised by the seller, by prior agreement on the place and time of handover.

Pack the goods responsibly and send them by registered mail to the seller’s address: MB “JM Ekspresas” Europos pr.85a, Kaunas, Lithuania LT-46287 , and provide the tracking number of the parcel. Failure to provide a valid tracking number shall be considered as non-return of the goods.

The buyer is also responsible for all delivery costs of the returned parcel.

The Buyer who returns the goods in accordance with the requirements set out above shall receive a full refund, including the original delivery costs. Upon receipt of the goods and after assessing their quality, the seller shall refund the goods within a maximum of 14 calendar days.

In the event that the buyer expresses a wish to return the goods before the date of delivery, the buyer shall be fully responsible for the cost of transport and shall be obliged to ensure the safety of the goods during the entire period of transport.

The Seller reserves the right to assess the condition of the goods to be returned and the Buyer shall be liable for any diminution in the value of the goods resulting from actions not necessary to determine the nature, characteristics and performance of the goods or from improperly prepared packaging. That is to say, the Seller shall be entitled to unilaterally reduce the amount to be refunded to the Buyer in proportion to the aforementioned diminution in value of the goods.

In the event of the Buyer returning the goods due to a defect or the quality issues of the goods, the Seller undertakes to refund in full to the Buyer the price paid for the defective goods and to cover the costs of delivery and return. If only part of the Goods are returned, the delivery costs shall be refunded on a pro rata basis.

The method of return of defective Goods shall be offered or arranged by the Seller. If a method of return other than that proposed by the Seller has been chosen which results in excessive or disproportionate costs, the Seller shall not be obliged to bear the costs of such return.

The buyer in all cases will have the rights arising from the sale of defective goods as provided for by the legislation of the Republic of Lithuania.

Warranty period of the goods

All new goods are subject to the manufacturer’s warranty period, which is stated in the description of the goods. In the event of a fault during the warranty period, the goods shall be repaired free of charge.

The warranty period shall take effect from the date of purchase of the goods, which is indicated on the invoice for the goods. The invoice (electronic or paper) shall be considered as proof of the validity of the warranty period.

In the event of a product failure, the Buyer must inform the Seller of the event by telephone or e-mail and deliver the product to the Seller’s physical store at the Seller’s physical store at MB “JM Ekspresas”, Europos pr.85a, Kaunas, Lithuania LT-45202, no later than during the warranty period at the Buyer’s own cost. The Buyer is also obliged to provide all information known to the Buyer about the circumstances of the failure of the goods.

The Seller shall inspect and evaluate the goods and shall inform the Buyer of the possibility of repair or replacement of the goods no later than 30 days after the goods are delivered to the Seller.

The warranty does not cover defects in electrical appliances caused by:

– misuse;

– due to disruptions in the electricity supply network;

– short circuits caused by external objects;

– the use of chemicals not intended for that purpose;

– parts which are subject to normal wear and tear during use and whose service life depends on the intensity of use of the appliance, such as light bulbs, parts made of glass, ceramics, textiles and paper;

– if the appliance has been repaired by a person not authorised to do so.

No refunds will be given for faulty goods within the guarantee period, except as provided for in the ‘Return Policy’.
